Shippiz Inc. — Terms of Service
PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THIS WEBSITE OR ANY SERVICES. BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
1. Parties and Scope
These Terms of Service ("Terms") constitute a legally binding agreement between Shippiz Inc. ("Shippiz," "we," "us," or "our"), a company registered in Delaware, and you, the individual or entity accessing or using the website at www.shippiz.com, the Shippiz API, or any related services (collectively, the "Services").
2. Definitions
- "Account" — any user account on the Website
- "API" — the application programming interface made available by Shippiz
- "Carrier" — any third-party shipping company, courier, or logistics provider
- "Order" — any shipment booking, rate comparison, or label generation request
- "Shipment" — any package tendered for transport via a Carrier through the Services
3. Description of Services
Shippiz is a technology platform enabling Users to compare shipping rates, place orders, generate labels, and track shipments across multiple Carriers. Shippiz is not a carrier and does not itself perform any shipment.
4. Third-Party Integrations
The Services may integrate with third-party platforms (e.g., Shopify, Amazon, WooCommerce). Shippiz does not control these platforms and is not responsible for any API outages or data transmission failures.
5. Account Registration
You must be at least 18 years of age. You are solely responsible for maintaining account security and for all activity under your account.
6. Booking Process and Orders
All Quotes are estimates only and are not guaranteed final prices. Carriers independently verify shipment details. All Orders are subject to applicable Carrier Terms.
7. Pricing, Fees, and Payment
Prices are estimated shipping costs only and do not include Customs Duties, taxes, or brokerage fees. By submitting an Order, you authorize Shippiz to automatically charge your payment method.
8. User Obligations and Export Compliance
You are responsible for providing accurate information, proper packaging, customs documentation, and compliance with export controls and sanctions.
9. Shipping Insurance
Optional insurance is available and underwritten by third-party insurers. Shippiz is not an insurer. Without insurance, you bear all risk of loss.
10. Cancellations and Changes
You may cancel an Order up to 3 hours before scheduled pickup. A cancellation fee of no less than $10 applies. No cancellation after collection.
11. API License
Shippiz grants a limited, non-exclusive, non-transferable, revocable license to access and use the API solely for your internal business operations.
12. Shippiz's Role; Carrier Responsibility
Shippiz is not a carrier. The Carrier is solely responsible for physical handling, transit, and delivery of Shipments.
13. Intellectual Property
All intellectual property rights in the Website, API, platform, and content are owned by Shippiz. You may not reproduce, copy, distribute, or create derivative works without prior written consent.
14. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTY OF ANY KIND.
15. Limitation of Liability
SHIPPIZ'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (I) FEES PAID IN THE 3 MONTHS PRECEDING THE EVENT, OR (II) $500.00 USD.
16. Indemnification
You agree to defend, indemnify, and hold harmless Shippiz from all claims arising from your use of the Services, breach of Terms, or inaccurate information.
17. Dispute Resolution
These Terms are governed by Delaware law. Disputes shall be resolved by binding individual arbitration. You waive the right to trial by jury and class actions.
